• <br />City of oR.olvo <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />2553 <br />4. Private driveway crossings of the Painters Creek drainageway shall <br />be allowed for each of Lots 3 and 4, subject to any permit approval <br />that may be required by the Minnehaha Creek Watershed District. <br />5. A private road shall be constructed to City Private Road <br />Requirements per the conditions of the Developer's Agreement executed <br />between the City and the developer. As of the date of this <br />resolution, engineering plans for the road have been approved by the <br />City subject to conditions of the Developer's Agreement, and <br />construction of the private road has commenced. Private road <br />construction must be completed by November 16, 1989. <br />6. The private road shall be privately owned and maintained per the <br />Declaration of Private Road Easement and Declaration of Covenants for <br />Maintenance of Same executed by the developer. <br />• 7. No building permits will be issued until the private road base <br />work has been completed and been approved by the City. <br />8. The aforesaid plat shall be filed by the City of Orono with the <br />Hennepin County Recorder's Office on or before June 12, 1989 together <br />with a certified original copy of this resolution and executed copies <br />of the documents as noted above. <br />The approval granted by this resolution shall expire if the plat <br />has not been f i led by the date specif ied above. In that event it wi 11 be <br />necessary to file a new application with the City of Orono for subdivision <br />review. <br />Dated this 12th day of December 1988. <br />rage 3 vi <br />
