• <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2551 <br />A RESOLUTION VACATING A PORTION OF A <br />DEDICATED DRAINAGE AND UTILITY EASEMENT <br />WITHIN THE PLAT OF DRAGONFLY HILL <br />SECTION 11, TOWNSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 1349 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, on October 6, 1988, Lauren Born and David Halper filed a <br />petition with the City of Orono requesting the vacation of a portion of a <br />drainage and utility easement originally dedicated within the plat of <br />Dragonfly Hill, Hennepin County, Minnesota, and legally described as <br />follows: <br />That part of existing drainage and utility easement being 10' in width <br />and also being the Southeasterly 10' of Lot 2, Block 1, Dragonfly Hill <br />lying Westerly of the Northeasterly 10' of said Lot 2; and <br />WHEREAS, after due published and posted notice a public hearing <br />was held before the Planning Commission on November 21, 1988 regarding said <br />vacation and all persons interested were given an opportunity to be heard; <br />and <br />WHEREAS, after due standing and consideration, the Planning <br />Commission recommended approval of the requested vacation and the Council <br />of the City of Orono finds that said vacation as proposed is in keeping <br />with the public interest. <br />NOW, THEREFORE, BE IT RESOLVED that the petition of Lauren Born <br />and David Halper is hereby granted, and that the portion of the drainage <br />and utility easement legally described above is hereby vacated. The <br />granting of the petition of vacation is subject to the condition that upon <br />vacation, applicants shall dedicate via quit claim deed to the City <br />drainage and utility easements 5' on either side of new division line <br />between their properties. <br />Adopted by the City Council of the City of Orono, Minnesota at a <br />regular meeting held December 12, 1988. <br />ATUST : <br />• o'othy " Iallin, City Clerk Jame R.
