Flint inquired whether the Applicant is agreeable to the conditions. <br />Johnson stated he is. <br />Sansevere moved, White seconded, to approve and adopt RESOLUTION NO. 4777, a Resolution <br />Renewing Variances to Terry Johnson and Jonell Johnson, 1045 Linden Lane, subject to the <br />conditions outlined in the March 20, 2002 Planner's Report. PIEPER, 3995 NORTH SHORE DRIVE — AFTER -THE -FACT <br />CONDITIONAL USE PERMIT — RESOLUTION NO. 4778 <br />Robert Pieper, Applicant, was present. <br />Pieper stated he is unsure why it was listed as after - the -fact since the unit has never been occupied. <br />Weinberger stated it was listed as an after - the -fact conditional use permit because the permits originally <br />showed only rough -in work and permits were not obtained for the work that was completed. <br />Weinberger stated the City was told the unit would only be roughed in and not finished. • <br />Pieper stated the building inspector was in the unit a number of times and did not say anything about a <br />conditional use permit being required. <br />Mayor Peterson stated a conditional use permit is required before anyone can reside in the apartment. <br />Pieper stated they decided to go forward with finishing the apartment off to avoid the mess from the <br />construction later on. Pieper indicated he has constructed a number of homes in the past, but was <br />unaware a conditional use permit was necessary. Pieper requested the extra fee be waived since he was <br />not aware he needed a conditional use permit. Pieper reiterated the building inspector inspected the site <br />a number of times and did not mention the need for another permit. Pieper stated he does not have a <br />problem with the permit fee, but questioned why the fee needs to be doubled. Pieper stated the <br />inspector has not issued the final occupancy certificate. <br />Nygard indicated he has recently applied for a permit, and without his experience on the Planning <br />Commission, he would have had difficulty complying. <br />Mayor Peterson stated the property owner needs to obtain a conditional use permit for the apartment. <br />Sansevere noted the applicant did indicate he has constructed a number of other homes in the past and <br />should have been aware of the need for the permit. <br />Pieper stated he did obtain the appropriate permits for construction of the house, but reiterated he was <br />not aware the apartment would need a conditional use permit. <br />PAGE 6 <br />
