• <br />• <br />City of OR ONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2582 <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B), <br />FILE NO. 1359 <br />WHEREAS, David J. Lindstrom (hereinafter "the applicant") is <br />owner of the property located at 1315 Woodhill Avenue within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Lot 1, Auditor's Subdivision #307, Hennepin County, Minnesota and that <br />part of Lot 13, Auditor's Subdivision #307, Hennepin County, Minnesota <br />described as beginning at the Northwest corner of said Lot 13, thence <br />East 251; thence South 157.751; thence West 25' to the Southeast <br />corner of Lot 1, thence. North to beginning (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.28, Subdivision 5 (B) to permit <br />construction of an addition to the west and southwest of the existing <br />residence requiring a front street setback variance of 1819" or 38% instead <br />of meeting the required 50' front street setback. The addition will <br />encroach no further into the substandard front yard setback area than the <br />existing structure. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1359. <br />2. The property is located in the RR -1B Single Family Rural <br />Residential Zoning District requiring a minimum of 2 acres of dry <br />buildable area. The property consists of approximately 1.3 acres. <br />3. The Orono Planning Commission reviewed this application on January <br />17, 1989 and February 21, 1989, and recommended approval of the <br />proposed variance based upon the following findings: <br />A) The existing structure is located 31' from the front street <br />setback line instead of the required 50'. <br />B) The location of the well on the south side of the house. <br />Page 1 of 4 <br />
