• <br />• <br />City of oR,olvo <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />2585 <br />A RESOLUTION WAIVING <br />APPLICATION OF SUBDIVISION REQUIREMENTS <br />FOR LOT LINE REARRANGEMENT FOR <br />RICHARD E. BROWN <br />FILE NO. 1085 <br />WHEREAS, the City of Orono is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted <br />subdivison regulations for the orderly, economic and safe develop- <br />ment of land within the City; and <br />WHEREAS, Richard E. Brown and Mary Page Brown, husband <br />and wife, and Richard A. Erickson and Julie E. Corty, husband <br />and wife, are owners of certain adjoining real property in the <br />City and desire to reconfigure their common lot line to accommodate <br />a portion of a tennis court; and <br />WHEREAS, the said lot line rearrangement involves an exchange <br />of small parcels of land to which the subdivision regulations <br />of the City would ordinarily apply; and <br />WHEREAS, under Minnesota law, the City Council is permitted <br />to waive application of the subdivision.regulations in certain <br />cases. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of <br />the City of Orono.hereby finds that the proposed lot line recon- <br />figuration constitutes a case in which compliance with Minnesota <br />subdivision laws and the subdivision regulations of the City <br />of Orono -will create an unnecessary hardship and that failure <br />to so comply does not interfere with the purpose of the sub- <br />division laws'and regulations, and, accordingly, pursuant to <br />Minn. Stat. § 452.358, subd. 4b, the City Council ot*the City <br />of Orono hereby waives compliance with the subdivision regulations <br />of the City*of Orono by Richard -E. Brown and Mary Page Brown, <br />husband and wife, and Richard A. Erickson and Julie E. Corty, <br />husband and wife, in connection with the reconfiguration of <br />their common lot line by execution and delivery of deeds in <br />the form attached to this Resolution as Exhibits A and B, and <br />the recording and filing thereof on the land records of Hennepin <br />County, Minnesota. <br />Adopted by the City Council of Orono, Minnesota, this 8th <br />day of March, 1989. <br />ATT ST; <br />City Clerk J s R.
