• <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2590 <br />A RESOLUTION GRANTING <br />-PRELIMINARY APPROVAL OF A <br />SUBDIVISION APPLICATION FOR <br />DONALD R. KEMPF <br />FILE NO. 1372 <br />WHEREAS, Donald R. Kempf (hereinafter "the applicant") on January <br />24, 1989 filed a formal subdivision application with the City for a Class <br />II Subdivision, plat of two lots of the property legally described as <br />follows: <br />The South 199.40' of the Southeast quarter of the Northeast quarter of <br />Section 07, Township 117, Range 23, Hennepin County, Minnesota, lying <br />East of County Road 151. Subject to a right-of-way easement over the <br />East 101, the North 10', and the South 101, (hereinafter "the <br />property") and; <br />WHEREAS, after due published and mailed notice in accordance with <br />Minnesota Statues 462.358 et. seq. and the City of Orono Zoning Code, the <br />Orono Planning Commission. held a public hearing on February 21, 1989 at <br />• <br />which times all persons desiring to be heard concerning this application <br />were given the opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on March 13, 1989, the <br />Orono City Council considered the subdivision application of the applicant, <br />noting the following findings of fact: <br />1. The property is located within the LR -1B Single Family Lakeshore <br />Residential Zoning District requiring a minimum of 1 acre of land <br />within each newly created lot. <br />2. The property contains a total of approximately 2.5+ acres. <br />3. The proposed plat contains 2 lots each exceeding the 43,560 s.f. <br />minimum lot area requirement (Lot 1 = 60,212 s.f.; Lot 2 = 58,325 <br />s.f.) . <br />4. Access to Lot 1 shall be via an approved curb cut at North Arm <br />Drive. Lot 2 shall be served via Loma Linda Avenue. Lot 2 has <br />adequate width along the public roadway providing adequate sighting <br />distance for the new curb cut. <br />5. All lots meet the required 140' width adjacent to the road and at <br />the rear of the front yard setback line. <br />• 6. A single family residence can be constructed on all proposed lots <br />without the need for any variances. <br />Page 1 of 4 <br />
