• <br />• <br />0 <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />e <br />2592 <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby grants a Conditional Use Permit per Municipal Zoning Code <br />Section 10.03, Subdivision 19 to permit the construction of a pond along <br />the east side of Fairway #12 of the Wayzata Country Club Golf Course, <br />subject to the following conditions: <br />1. Spoils shall be placed at the applicants regular fill site in the <br />City of Wayzata. Applicant is advised to obtain whatever permits may <br />be necessary from the City of Wayzata for the regular fill site. If <br />that site is not used and some site ,in Orono is proposed, the proposed <br />fill site will need further review by the City. <br />2. The property owner and his grading contractors shall take whatever <br />steps are necessary to ensure that grading and excavation of this site <br />does not adversely affect any other drainageways in the area due to <br />erosion or sedimentation. The disturbed areas shall be revegetated as <br />soon as possible. <br />3. The property owner shall provide a legal description and grant a <br />conservation and flowage easement over the 1/4 acre pond to be created <br />and the adjacent 1/2 acre pond. <br />4. The applicant is advised to contact the Minnehaha Creek Watershed <br />District to obtain any permit they may require for construction of <br />this pond. <br />5. Violation of or non-compliance with any of the terms and conditions <br />of this resolution shall constitute a violation of the Zoning Code, <br />shall automatically terminate any authority granted herein, and shall <br />be punishable as a misdemeanor. <br />6. The undersigned owner has read, understood and hereby agrees to the <br />terms of this resolution and on behalf of himself, his heirs, <br />successors and assigns, hereby agrees to the recording of this <br />resolution in the chain of title of the property. <br />Page 2 of 4 <br />
