d City of ORONO <br />• RESOLUTION OF THE CITY COUNCIL <br />2527 <br />NO. <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 & 2 <br />AND SECTION 10.55, SUBDIVISION 8 <br />FILE #1311 <br />WHEREAS, John & Susan Purdy (hereinafter "the applicants") are <br />the owners of the property located at 1975 Fagerness Point Road within the <br />City of Orono (hereinafter "City") and legally described as follows: <br />Lot 5, Fagerness, Hennepin County, Minnesota (hereinafter "the <br />property") ; and <br />WHEREAS, the applicants have applied to the City for variances to <br />Municipal Zoning Code Section 10.22, Subdivisions 1 & 2 and Section 10.55, <br />Subdivision 8 to permit the construction of an addition to the existing <br />•residence, such addition being located partially in the 0-75' lakeshore <br />setback zone where no construction is normally allowed, and such <br />construction technically encroaching past the defined average lakeshore <br />setback line where no encroachment is normally allowed, and which <br />construction shall comprise additional structural hardcover on the property <br />in excess of the 0% hardcover normally allowed in the 0-75' zone and in <br />excess of the 25% hardcover normally allowed in the 75-250' lakeshore <br />setback zone. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed'as Zoning File #1311. <br />2. The property is located in the LR -1C Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on October <br />17, 1988 and recommended approval of the proposed variances based upon <br />the following findings: <br />A) The applicants have revised their original proposal to now <br />include only an addition of 16'x4216", identical to the 5 -year <br />• phased addition plan which was reviewed by the City in 1985. <br />B) The proposed addition encroaches no closer to the westerly <br />lakeshore of the property than the existing house, and only a <br />small portion of the addition will be located within the 0-75' <br />setback zone. The proposed addition continues the existing west <br />line of the house. page 1 of 4 <br />
