• <br />J d City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2518 <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 6 (B) <br />FILE 11341 <br />i <br />WHEREAS, Todd Ziesmer (hereinafter "the applicant") has an <br />interest in the property located at 3440 Bayside Road within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.23, Subdivision 6 (B) to permit the <br />construction of a single family residence on a lot of 118' in width where a <br />200' lot width is normally required for construction of a single family <br />• residence. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1341. <br />2. The property is located in the LR-lA Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on October <br />3, 1988 and recommended approval of the proposed variance based upon <br />the following findings: <br />A) A residence previously existed on the property and was only <br />recently removed due to its poor condition. <br />B) The property is 2.35 acres in area. <br />C) The proposed residence meets the required 30' side setbacks <br />and greatly exceeds the required 50' minimum front setback for <br />construction of a single family residence in the LR-lA zone. <br />• D) Applicant has provided septic testing to verify that a <br />primary and alternate drainfield site can be developed within the <br />property boundaries. <br />Page 1 of 4 <br />
