• <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2516 s <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 15 (C) AND <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #1332 <br />WHEREAS, Marcelo Gumucio (hereinafter "the applicant") is the <br />owner of the property located at 980 West Ferndale Road within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for after -the -fact <br />variances to Municipal Zoning Code. Section 10.03, Subdivision 15 (C) and <br />Section 10.28, Subdivision 5 (B) to permit the construction of driveway <br />oetrance monuments exceeding the maximum 3.5' height limitation and located <br />ss than 1' from the property line where a 50' minimum front setback would <br />normally be required for such structures. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1332. <br />2. The property is located in the LR-lA Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />September 19, 1988 and recommended approval of the proposed -variance <br />based upon the following findings: <br />A) The pillars do not create a hazard to the users of the public <br />roadway nor of the private driveway because of the 15-20' setback <br />from the travelled roadway, and will not impede road maintenance. <br />B) Separation distance between the pillars provides adequate <br />clearance for emergency vehicles that may have to service the <br />property. <br />• C) The pillars contain integral <br />safety of.this driveway entrance. <br />Page 1 of 4 <br />lighting fixtures to provide for <br />
