The Orono Planning Commission reviewed this application on October <br />3, 1988 and recommended approval of proposed setback variances to <br />Sections 10.20, Subdivision 3 (D) and Section 10.25, Subdivision 6 (B) <br />and per Section 10.20, Subdivision 3 (D) recommends approval of the <br />granting of a conditional use permit for the construction of a pumping <br />station/lift station, based on the following findings: <br />A) The applicant has filed the necessary subdivision application <br />with the City to allow the legal transfer of the outlot to the <br />M.W.C.C. <br />B) The amendment of the original improvement plan (Application <br />#1256) for the upgrading of the existing sewer lines owned by the <br />M.W.C.C. is required and is considered an important, integral <br />part of the proposal. <br />• C) The proposed structure will have no major impact on the <br />surrounding residential property nor on the use of the adjacent <br />commercial property. <br />6. The City Council finds that the conditions existing on this pro- <br />perty are peculiar to it and do not apply generally to other property <br />in this zoning district;. that granting the variance would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard <br />or other danger to neighboring properties; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demon- <br />strable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the <br />spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />7. The City Council finds that granting a conditional use permit to <br />allow the installation of a pumping station/lift station will not be <br />detrimental to the health, safety or general welfare of the public, <br />would not adversely affect light, air nor pose a fire hazard or other <br />danger to neighboring properties, nor will it depreciate surrounding <br />property values and that the proposed level of use of the property <br />will be in keeping with the intent and objectives of the Zoning Code <br />and Comprehensive Plan of the City. <br />• Page 2 of 5 <br />
