City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2504 <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #1312 <br />WHEREAS, William J. Lauer (hereinafter "the applicant") is the <br />owner of the property located at 3165 North Shore Drive within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />See Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.22, Subdivision 2 to permit the <br />construction of,an addition to the existing residence resulting in an <br />increase of 502 s.f. or 1.89% of new structural hardcover within the 75- <br />250' setback area where 7,748 s.f. or 29.9% of hardcover improvements exist <br />already and where only 25% is allowed. <br />• NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1312. <br />2. The property is located in the LR -1B Single Family Lakeshore <br />Residential Zoning District requiring a minimum of one acre or 43,560 <br />s.f. The subject property consists of 1.43 acres or 62,308 s.f. <br />3. The Orono Planning Commission reviewed this application on August <br />15, 1988 and recommended approval of the proposed variance as amended <br />based upon the following findings: <br />A) There is no hardcover within the 0-75' setback area. <br />B) The existing house is located 175' from the defined lakeshore <br />at the 929.4 elevation. <br />C) There are no excesses in hardcover within the 250-500' <br />setback area. <br />4. The City Council has considered this application including the <br />findings and recommendations of the Planning Commission, reports by <br />City staff, comments by the applicant and the effect of the proposed <br />variance on the health, safety and welfare of the community. <br />Page 1 of 4 <br />
