MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,October 18,2004 <br /> 6:00 o'clock p.m. <br /> (#04-3042 Pillar Homes,Continued) <br /> Shermack stated he did not apply for a conditional use permit for the excess fill because he was <br /> unaware of the City's requirement. Shermack indicated he is now appearing before the Planning <br /> Commission to request a grading permit based on the excess fill that was utilized on this site. <br /> Shermack stated he would also like to address the City Engineer's comments. First,prior to the <br /> landscaping plan being submitted to Staff, at least two site visits were had with members of Staff who <br /> advised the landscape architect on what steps should be taken. Shermack pointed out there is a two- <br /> foot trench with drain tile and rock on top. Shermack stated the surveyor was not instructed to dig <br /> down to the drain tile and so the elevations depicted on the survey reflect the top of the stone placed in <br /> the swale along the pool. Shermack stated they attempted to be very pro-active in their approach to <br /> address the drainage on this property and met with staff a number of times to discuss issues relating to <br /> drainage. <br /> Leslie inquired where the drain tile discharges. <br /> Tupper stated the drain tile discharges at about the 938', 937' contour to the west. <br /> Rahn inquired whether there were any public comments regarding this application. <br /> There were no public comments. <br /> Tupper stated the construction of the swale begins at the 941' elevation at the block retaining wall, <br /> which is in the northeast corner. Tupper stated the 941' is the high point,with the swale being <br /> constructed five feet from the center point of the swale to the property line and with the swale being <br /> sloped towards the lake. In addition, a trench was dug about two feet wide and two feet deep with <br /> drain tile on the bottom, which was then filled with rock to the top of the trench. Tupper stated the <br /> rock on top is more of a cosmetic feature to make the swale appear like a creek bed. Tupper stated it is <br /> their understanding some of the elevations were shot on top of the rock instead of where the soil line <br /> was. <br /> Leslie inquired whether there is also drain tile in the eastern portion of the swale as it approaches the <br /> pond. <br /> Shermack stated there is not. <br /> Rahn inquired whether the home was constructed at the elevation approved. <br /> Shermack stated the home was constructed at the proper elevation. <br /> Jurgens inquired what the building permit specified for the elevation. Jurgens stated he would like to <br /> see a copy of the building permit. Jurgens noted the top of foundation was proposed at 943.8'. <br /> Jurgens inquired what type of joist was utilized. <br /> PAGE 9 <br />
