� <br /> Sec.13.04 RIGHTS OF SLIB.TECTS OF DaT� <br /> Subd. 1. Type of data. The rights of individual on whom[he data is stored or to be stored shall be as set fonh in this secdon. <br /> Subd.2. Information reqirired to be given individual. ?.n individual asked to supply private or confidenrial dara concerning himself shall <br /> be informed of: (a) the purpose and intended use of the requesied dan within the collecRng"state agency, polidcal subdivision,or statewide rystem; <br /> (b)whether he may refuse or is legally required to supply the requested data;(c)any Irnown coasequence arising fmm tus supplying or refusing to supply <br /> • pcivace or confidenrial data;and(d)the idenary of o�her persons or enanes au[horized by state or federal law to receive the data. This requirement shall <br /> noc apply when an individual is asked to supply invesrigarive dara, pursuant to secaon 13.82, subdivision 5, to a law enforcement officer. - <br /> The commissioner of revenu� mav place the noacA rauired under this subdivision in the individual income tax or propem tax refund <br /> instrucrions instead of on chose forms. <br /> Subd. 3. Access to data by indi�Zdual. Upon request to a responsible auchority,an individual shall be informed whether he is the subject <br /> of stored data on individuals,and whe[her ic is classified as public, private or confidendal. Upon his further request, an individual who is the subject <br /> of stored private or public data on individuals shall be shown the data wichout any charge to hun and, if he desires, shall be infocmed of the eontent <br /> and meaning of[hat data. Aher an individual has been shown the privace data and informed of ics meaning,the data need not be disclosed to him for <br /> six mon�hs[hereafter unless a dispute or acaon pursuanc to this secdon is panding or addidonal data on the individual has been collected or created. <br /> The responsible authoriry shall provide copies of the private or public data upon requesc by the individual subject of che data. The responsible authoriry <br /> may require the requesting person to pay the actual cosrs of making, cerafying, and compiling the copies. <br /> The responsible au[horiry shall comply immediately, if possible, with any request made pursuant to this subdivision,or within five days of <br /> the dare of the request,excluding Saturdays,Sundays and leeal holidays,if immediace compliance is noc possible. If he cannoc compty with the requesc <br /> wichin chat time,he shail so inform the individual,and may have an addiaonal five days wiehin wtuch to comply wich the request,exciuding Saturdays, <br /> Sundays and legai holidays. <br /> Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private <br /> data conceming himself. To exercise chis rieht,an individual shall noafy in wricin;the responsible authority describing the nacure of[he disagreement. <br /> The responsible auchoriry shall within 30 days eicher: (a)correct the data found to be inaccurate or incomplete and attempt to nodfy past recipients of <br /> inaccurare or incomplete da�a, including recipients named by [he individual; or(b)noufy the individual thac he believes the data to be correcc. Data <br /> in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. ' <br /> The decerminarion of the responsible authoriry may be appealed pursuant to the provisions of the admuustradve procedure act reladng to <br /> contested cases. <br /> DATA PRIVACY ADVISORY <br /> In accordance with M.S. 13.04, Subd. 2, "Rights of subjects of data", we would like to inform you that your request <br /> for a permit or license from the City of Orono or any of i[s departments may require you to furnish certain private or <br /> confidential information. <br /> You are notified that: <br /> 1. The information you furnish will be used to determine your qualification for the permit or license requested. <br /> 2. You may refuse to supply data, but refusal may require that the City deny the permit or license. <br /> 3. The information may be shared with other local, state or federal agencies to the exten[necessary to process <br /> the permit or license. <br /> 4.
