MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> MONDAY, APRIL 19, 2004 <br /> 6:00 o'clock p.m. <br /> (#5. 04-2993 CHRIS VALERIUS, 2377 SHADYWOOD ROAD,VARIANCE, <br /> CONDITIONAL USE PERMIT—Continued) <br /> existing residence into a coffee shop/bakery/restaurant as the site cannot support the requested <br /> drive-through which also creates the need for approval of an unnecessary front yard parking <br /> variance and hardcover variance. <br /> VOTE: AYES 4, NAYS 3. <br /> Jurgens indicated he thought the site could still work with a drive-through and that a traffic study is <br /> needed to assess future traffic volumes for safety concerns. <br /> Bremer indicated she thought the plan is consistent with the neighborhood adjacent properties and <br /> even is more environmentally aware than its adjacent properties, like Snyders Drug and the corner <br /> gas stations that are primarily all blacktopped. She could support the plan with the use of pavers for <br /> improved aesthetics. <br /> Berg indicated the plan is like the neighborhood it is in. <br /> Chair Mabusth declared the vote is to recommend denial of the drive-through plan. <br /> Leslie moved, to recommend approval of Application #04-2993, Alternate Plan that does not <br /> include a drive-through, Christine Valerius and Phil Fisk, 2377 Shadywood Road, Commercial <br /> Site Plan Review, Parking,Hardcover and Building Setback Variances, Conditional Use Permit <br /> to convert the existing residence into a coffee shop/bakery/restaurant, stipulating that the three <br /> season porch be removed in an effort to reduce non-conformities. <br /> Bremer asked for an amendment to the motion to allow the applicants to have their choice of <br /> permanent removal or moving the three-season porch to a conforming location on the building. <br /> Leslie accepted the motion amendment, Chair Mabusth seconded, to recommend approval of <br /> Application #04-2993,Alternate Plan that does not include a drive—through, Christine Valerius <br /> and Phil Fisk, 2377 Shadywood Road, Commercial Site Plan Review, Parking, Hardcover and <br /> Building Setback Variances, Conditional Use Permit to convert the existing residence into a <br /> coffee shop/bakery/restaurant, and to allow the applicants to have their choice of permanent <br /> removal of the three season porch or to move it to a conforming location on the building. <br /> VOTE: Ayes 7, Nays 0. <br /> Mr. Fisk asked for direction of what information to bring to the subsequent City Council meeting, <br /> such as the paver concept. <br /> Berg suggested a drawing showing less hardcover with no curb and gutter. <br /> Chair Mabusth suggested the applicants ask for the additional comments from the City Engineer. <br /> Mr. Fisk and Ms. Valerius thanked the Planning Commission for time spent on their application <br /> review. <br /> Page 30 of 49 <br />
