A Homeowners Association has been developed for ownership and maintenance of <br /> the private road to be located within Outlot A. The Homeowners Association shall <br /> also be responsible for maintenance of all stormwater facilities serving the <br /> subdivision, including the outlet structure within Lots 5 and 6. <br /> 6. Subdivider has granted to the City an underlying Road and Utilities Ea�ement for <br /> Outlot A. <br /> 7. The MCWD has conditionally appro��ed the grading and drainage impro��ements on <br /> this property and the wetland fill to accommodate the culvert under the Luce Line <br /> Trail to the south being reduced from 36" to 18". <br /> 8. Creation of covenants for all lots for protection of drainfield sites, including <br /> protective language for alternate septic sites along with site plans locatin� both <br /> primary and alternative sites, and alerting future property owners of the need to <br /> protect sites on adjacent properties. <br /> 9. Execution of a Subdivider's Agreement providing for the installation of draina�e and <br /> stormwater facilities required as a condition of subdivision approval, and postinQ of <br /> security to ensure that these required improvements are completed to the City's <br /> satisfaction, the design of said improvements subject to approval of the City <br /> Engineer. <br /> 10. Applicant has granted a 10' wide trail easement along the west boundary of the <br /> property. <br /> 11. Payment to the City for the final plat review fee and fee for legal revie«-and filinQ <br /> of the plat, easements and covenants in the amount of$400.00. <br /> 12. Payment to the City for park dedication fees for the creation of six(6) ne�;-lots in the <br /> amount of$29, 400. <br /> 13.
