• • MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday,June 20,2005 <br /> 6:00 o'clock p.m. <br /> (#05-3097 Hashem Abukhadra,Continued) <br /> Kempf inquired whether it is possible to access the garage from the other side. <br /> Abukhadra stated it is not. <br /> Gaffron noted it is a tuck-under garage. <br /> Rahn inquired whether the subdivision increases the nonconformity of the guesthouse. <br /> Gundlach stated a variance to two lot lines would need to be granted. <br /> Rahn stated if the guesthouse does not increase in nonconformity,he would not have an issue with the <br /> guesthouse remaining. <br /> Gronberg stated if it is not considered a back lot,it would meet the side setbacks. <br /> Gundlach stated the guesthouse would need to meet a 30-foot setback even if it was not considered a back <br /> lot,which it currently does not meet. <br /> Gronberg stated the subdivision does not increase the nonconformity. <br /> Gundlach concurred that the nonconforming setback to Fox Street is not being increased with the <br /> subdivision. <br /> Bremer indicated she does have a concern with having two accesses to this property. Bremer stated the <br /> compromise in her view to allowing the guesthouse to remain is to eliminate the access onto Fox Street. <br /> Jurgens indicated he also has a concern with the two access points but would allow the guesthouse to <br /> remain. <br /> Rahn inquired whether the Planning Commission members have any concerns regarding Lot 6 being <br /> considered a back lot. Rahn inquired if the building pad would be affected significantly if Lot 6 were <br /> considered a back lot. <br /> Gundlach indicated the house would need to be located an additional 15 feet from the lot line. <br /> Gronberg inquired whether the amount of frontage on the street is taken into account in determining <br /> whether a lot should be considered a back lot. <br /> Gaffron stated the reason the back lot code exists is to reduce the impacts of the front lot, and in order to <br /> reduce those impacts, greater setbacks for structures are required on the back lot from the shared lot line. <br /> Gaffron stated regardless of whether the frontage is 300 or 600 on Fox Street, the lot with the existing <br /> house acts as a back lot in relation to the lots to the west of it and that in his view it should be considered <br /> a back lot. <br /> PAGE 6 <br />
