MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> • Monday,May 16,2005 <br /> 6:00 o'clock p.m. <br /> ROLL <br /> The Orono Planning Commission met on the above-mentioned date with the following members present: <br /> Chair David Rahn, Commissioners J. Marc Fritzler,Travis Winkey, Cynthia Bremer,Roland Jurgens,Jim <br /> Leslie, and Ralph Kempf. Representing Staff were Planning Director Mike Gaffron,Planners Melanie <br /> Curtis and Janice Gundlach, and Recorder Jackie Young. City Council Member Lili McMillan was <br /> present. <br /> City Engineer Tom Kellogg arrived at 6:13 p.m. <br /> Chair Rahn called the meeting to order at 6:00 p.m. <br /> OLD BUSINESS <br /> 1. #05-3098 CITY OF ORONO, SECTION 78-1285 SHORELAND MANAGEMENT, <br /> ZONING CODE AMENDMENT,6:01 P.M.—6:55 P.M. <br /> Gaffron addressed the Orono Planning Commission concerning an amendment to Section 78-1285 of the <br /> Shoreland Management Zoning Code. Gaffron noted the Planning Commission reviewed the proposed <br /> language at their April work session where it was felt that the addition of language making the <br /> "Vegetations Alterations"ordinances applicable to protected tributaries could have impacts on a large <br /> number of properties. Staff was directed to notify individually the 100 plus owners of property located <br /> within 75 feet of a protected tributary to inform them of the proposed amendment and gather public input <br /> regarding this new element of the amendment. <br /> Gaffron stated the proposed language reads as follows: "Invasive Species Removal. Removal of <br /> buckthorn and other invasive or exotic plant species is encouraged by the City. However, such removals <br /> when occurring within 75 feet of the shoreline of a lake,within 75 feet of the OHWL of a tributary <br /> stream, on steep slopes or within the bluff impact zone within the shoreland overlay district,have a <br /> potential to result in conditions that could be considered as intensive vegetation clearing. Therefore,the <br /> following regulations shall apply for such removals: <br /> 1. The property owner shall obtain a City permit prior to invasive species removal when such <br /> removals are located: <br /> (i) within 75 feet of the shoreline of a lake or the OHWL of a tributary; or <br /> (ii) on steep slopes; or <br /> (iii) within a bluff impact zone, <br /> In order to obtain a permit,the property owner shall provide a site plan indicating the location, species, <br /> number and size of proposed vegetation removals. <br /> PAGE 1 <br />
