Leslie stated one option to restrict <br /> pedestrian traffic to the lower level from the upper level would be to gate the stairway,which may be <br /> against City Code. <br /> Liza Kreslie stated the side of the building that faces Champion Auto belongs to Keaveny's and that she <br /> has not been allowed to do anything with that side of the building. Kreslie stated in her opinion the <br /> customers of Jul Ann would try to utilize the top lot and then attempt to access the lower level. Keslie <br /> indicated she would like more information on the parking issues. <br /> Fritzler stated he sees the possibility that a parking easement from Keaveny would be needed and that <br /> parking in his opinion is an issue on this lot. Fritzler stated he would be reluctant at this time to grant <br /> any variance on the parking and would like to see some documentation on the shared access. Fritzler <br /> noted there also is the possibility that people catching the bus in that location would park on this lot and <br /> occupy some of the stalls for the majority of the day. <br /> Frizler inquired whether there would be any issue with adverse possession concerning the parking. <br /> Bremer stated to her knowledge, if sorheone allows parking on their lot, it is not adverse possession and <br /> that it sounds like it has been permitted for a number of years. Bremer stated she would like to see some <br /> type of agreement that would be binding for as long as Keaveny owns the building. Bremer noted that <br /> agreement would need to be renegotiated if the owner of the building changes. <br /> Bremer commented she was unaware of the parking issues for this lot,but that it would be difficult to <br /> include the parking spaces where the dumpster is located. <br /> Overson indicated the dumpster could be relocated and that it was initially located there to provide easy <br /> access for the refuge company. <br /> Fritzler commented in his view the owner of the property has neglected to keep this site clean and that <br /> items have been placed on the lot that have been there for quite a while. <br /> Overson stated people of their own volition have periodically dumped items there. Overson stated he is <br /> willing to clean up the property and that he was not fully aware of the current condition of the property. <br /> Rahn reiterated the parking remains an issue and that he would prefer a revised plan showing how the <br /> parking would meet the requirements of the City. Rahn stated the applicant does have the option of <br /> tabling her application in order to consider her options. Rahn suggested the applicant consider meeting <br /> with Staff to discuss the parking issues. <br /> Mr.Kreslins requested the application be tabled. <br /> Rahn moved,Fritzler seconded,to table Application#05-3085,Julie Kreslins on behalf of Jul <br /> Ann,Inc., and Building Owner Aleck Overson,3455 Shoreline Drive.
