The proposed deck is proposed to be located adjacent to a <br /> portion of the house that is more distant from the lakeshore than <br /> . . �the closest point to the lakeshore of the existing house. The <br /> proposed deck will constitute new structural hardcover in the 0- <br /> 75' zone, but will have no effect on neighboring views of the <br /> lake. The proposed deck location is less obtrusive than if it <br /> was placed further north on the property. <br /> B) The site plan of the existing house on this long, narrow lot <br /> precludes a more conforming layout of their proposed addition, <br /> given that the existing house already encroaches partially into <br /> the 0-75' setback zone. <br /> C) The large non-hardcovered yard area helps to decrease the <br /> effect of hardcover on the property. The total hardcover that <br /> would be allowed on the property would be 13,400 s.f. The <br /> proposed hardcover is just over 9,000 s.f. The lot area is <br /> • approximately 1.15 acres. <br /> D) The app licant can remove areas of non-structural hardcover <br /> in the 0-75' zone that will result in a net decrease in 0-75' <br /> � hardcover of approximately 66 s.f. or 1�. Additionally, non- <br /> � structural hardcover in the 75-250' zone can be removed so that, <br /> ' in conjunction with the proposed deck and addition, the net <br /> - hardcover increase is 244 s.f. or 1.5$. This results in final <br /> : hardcover on the property of 8.6� in the 0-75' zone and 34.6$ in <br /> the 75-250' zone, and leaves 9.6� in the 250-500' zone where as <br /> • much as 30$ would normally be allowed. <br /> 4. The City Council has considered this application including the <br /> � findings and recommenaations of the Planning Commission, reports by <br /> ' City staff, comments by the applicant and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> , 5. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> ` property in this zoning district; that granting the variance would not <br /> ' adversely affect traffic conditions, light, air nor pose a fire hazard <br /> , or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a demon- <br /> • strable hardship or difficulty; is necessary to preserve a substantial <br /> � property right of the applicant; and would be in keeping with the : <br /> spirit and intent of the Zoning Code and Comprehensive Plan of the , <br /> ; • City. <br /> � <br /> Page 2 of 5 <br /> ; <br /> � <br /> i . <br /> � <br /> [ <br /> � <br /> � <br /> i <br />
