MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />MONDAY, JULY 24, 2000 <br />• <br />( #2600 BRIAN KERBER, Continued) <br />right to construct one of the 1,000 square foot buildings as a condition of the variance being <br />granted. <br />Mayor Jabbour stated the Applicant would still be allowed to construct a 1,000 square foot <br />building on his property but he would be giving up his right to construct two 1,000 square foot <br />buildings if he elects to construct the 2,160 square foot pole barn. <br />Sansevere inquired whether a future property owner would be held to the same restriction. <br />Mayor Jabbour stated that would be part of the agreement. <br />Kelley reiterated City Staff should review this part of the code. <br />Sansevere commented the wetland area of the property should also be taken into consideration <br />when considering this type of application. <br />Kelley stated he is in agreement that the amount of wetland on the property should be considered <br />and that perhaps the code should apply only to dry buildable land rather than the total acreage. <br />Mayor Jabbour stated lie also is in agreement that the code should apply to dry buildable land only. <br />• Flint inquired whether the Applicant will be relocating the garage further back. <br />Kerber stated he will attempt to push the garage back as far as possible, but noted that he is unable <br />to relocate it much further back due to the steep grade that exists at the rear of his property. Kerber <br />stated he could possibly locate it six to eight feet further back. <br />Kelley stated in his view the hardship is the storage of this vehicle and trailer. Kelley inquired <br />what assurance the City Council would have that this vehicle and trailer will be parked inside the <br />building. <br />Kerber indicated he has gone through six trailers in the past ten years by having them sit outside and <br />having them rust due to the elements and would prefer to store his vehicle and trailer indoors. <br />Kelley reiterated that he would like the Applicant to store this vehicle and trailer inside rather than <br />utilize the pole barn for storage of other items. <br />Kerber stated he would be willing to put this into writing if so requested. <br />Sansevere commented the fact that the Applicant needs storage for his vehicle and trailer is not <br />a hardship in his view. <br />Kelley stated the City Council is required by law to grant variances based on a hardship. <br />• Sansevere commented in his view that may not constitute a hardship. <br />Page 5 <br />
