d cit o� oR,oNo <br /> � <br /> • � RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2445 <br /> • � • • _ <br /> c) The proposed cantilevered addition will be located 8.6' <br /> from the side lot line with a 2' over hang, but will be no <br /> closer to that lot line than the existing cover�ed walkway <br /> structure attached to the house, and will have no impact on <br /> the neighboring residence which is �more than 50' away. <br /> 4. The City Council has considered this application including . <br /> the . findings and recommendations of the Planning Commission, <br /> � reports by City staff, comments by the applicant and the effect , <br /> of the proposed variance on the health, safety and welfare of the <br /> community. <br /> 5. The City Council finds that the conditions existing on this <br /> � property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance <br />. would not adversely affect traffic conditions, light, air nor <br />; pose a fire hazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br />: • necessary to preserve a substantial property right of the <br /> applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> CONCLIISIOPS, ORD$R AND CONDITIONS <br />' Based upon the above findings, the Orono City Council hereby <br /> grants a variance to the Municipal Zoning Code Sections 10.22, <br /> " Subdivision 2 and 10.24, Subdivision 5(B) to permit the construction <br /> of a second story addition to be located 8.6' from the side lot line <br /> � with overhang located 6.5' from the side lot line, where a 10' side <br /> . yard setback is normally required, and grants a variance to allow <br /> 44.5$ hardcover in the 75-250' setback zone where only 25� hardcover ' <br /> � is normally allowed, subject to the following conditions: <br /> l. Hardcover on the property is allowed only as follows: • <br /> � 0 '-75' Zone: (Area = 3,975 s.f. ) <br /> ; Existing stepping stones 20 s.f. <br /> ?
