a;: �,, _ <br /> d C�t� of ORONO <br /> • RESOLUTION OF THE C�TY COUNCIL <br /> � <br /> � NO. 2431 <br /> • � • • <br /> A RESOLDTION GRANTING <br /> VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.03, SIIBDIVISION 13, <br /> SECTION 10.22, SDBDIVISION 2, <br /> SECTION 10.03, SUBDIVISION 15(F) , AND <br /> SECTION 10.25, SIIBDIVISION 6(B) <br /> FILE #1260 <br /> WHEREAS, John Nyquist (hereinafter "the applicant") is the owner <br /> of the property located at 1432 Baldur Park Road within the City of Orono <br /> (hereinafter "City") and legally described as follows: <br /> Lot 7 , Block l , Baldur Park, Hennepin County, Minnesota <br /> (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for a variance to <br /> Municipal Zoning Code Section 10.03, Subdivision 13 and 10.03, Subdivision <br /> 15(F) to allow construction of a detached garage to be located 5' from the <br /> •side lotline and 20' from the street lot line where a side setback of 10' <br /> and a street setback of 30' are normally required, and for a variance to <br /> Section 10.22, Subdivision 2 to allow hardcover in excess of the 25$ <br /> hardcover normally allowed in the 75-250' lakeshore setback zone. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #1260 . <br /> 2. The property is located in the LR-1C Single Family Lakeshore <br /> Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application on April <br /> 18, 1988 and recommended approval of the proposed variance based upon <br /> the following findings: <br /> A) The existing garage located 2' from the side lot line wi 11 <br /> be replaced with a new, larger garage located 5' from the lot <br /> line. The 5' side setback variance is justified by the need to <br /> maintain an adequate corridor to the right side of the garage for <br /> future well maintenance access, and will provide a more useful <br /> yard area than if the garage was centered on the property. <br /> • Page 1 of 5 <br />
