t <br /> City of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> • NO. 2416 <br /> rs � <br /> to the current 2 acre requirement in 1975. The property is considered <br /> a lot of record in single separate ownership per Section 10.03 , <br /> Subdivision 6 A (3) of the Orono Municipal Zoning Code. <br /> 5. The property cannot be put to a reasonable use if used under <br /> conditions allowed by the offical controls. <br /> 6. The plight of the landowner is due to circumstances unique to his <br /> property not created by the landowner. <br /> 7. The variance, if granted, will not alter the essential character <br /> of the locality. <br /> 8. The City Council has considered this application, including the <br /> findings and recommendations of the Planning Commission, reports by <br /> City staff, comments by the applicant, and the effect of the proposed <br /> variance on the health, safety and welfare of the community. <br /> 9. The City Council finds that the conditions existing on this <br /> property are pecular to it and do not apply generally to other <br /> property in this zoning district; that granting the variance would not <br /> adversely affect traffic conditions, light, air, nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve <br /> as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a <br /> substantial property right of the applicant; and would be in keeping <br /> with the spirit and intent of the Zoning Code and Comprehensive Plan <br /> of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted above, the Orono <br /> City Council hereby grants a variance to Municipal Zoning Code Section <br /> 10.28, Subdivision 5 (B) to permit the construction of a single family <br /> residence on the 1.37 acre vacant property at 20 Cygnet Place, subject to <br /> the following conditions: <br /> 1. The existing accessory shed shall be moved to a conforming <br /> location behind both front lines of the proposed house, prior to <br /> issuance of a certificate of occupancy for the house. <br /> 2. Driveway access shall be to Cygnet Place and shall be located at <br /> least 100' south of the intersection of Watertown Road and Cygnet <br /> Place. The driveway routing within the property shall be located so <br /> as not to interfere with the primary and alternate drainfield sites. <br /> Page 2 of 4 <br />
