Applicant shall provide a soil erosion plan at the time of <br /> application for a building permit for either the retaining wall <br /> ' or the new residence for all land alteration activities <br /> associated with new construction. <br /> 3. All activities involving the transport of fill to the building <br /> site shall be limited to the hours of 8 :00 AM - 4 :30 PM on <br /> weekdays only (Monday through Friday) . <br /> 4. Applicant and/or future owner of the property is hereby <br /> advised that the City will not approve any further encroachment <br /> of the lakeshore protected area with future requests to alter the <br /> existing elevations. <br /> • 5. Authorities granted by �this resolution run with the property <br /> not with the applicant, but are permissive only and must be <br /> exercised by application for a building permit within one year of <br /> the date of Council approval, �or the special conditions of this <br /> resolution will expire on that date (April 25, 1989 ). <br /> 6. Violation of or non-compliance with any of the terms and <br /> conditions of this resolution shall constitute a violation of the <br /> zoning code, shall automatically terminate any authority granted <br /> herein, and shall be punishable as a misdemeanor. <br /> 7.
