Included in the proposal is reconstruction of the sidewalk <br /> and stair system to the east side of the house, and continuation <br /> of a retaining wall at the southwest side of the house. The <br /> patio underneath the deck will also be revised. All of the above <br /> rev�ision to the property can be completed so that there is no <br /> hardcover increase on the property above the existing 31.8$ <br /> Hardcover in the 0-75' lakeshore setback zone is 2.1�, with no <br /> change proposed. " <br /> D) There is no significant unnecessary hardcover existing on the <br /> property that could be removed to significantly decrease the 75- <br /> 250 ' hardcover. <br /> 4. The City Council has considered this application including the <br /> findings and recommendations of the Planning Commission, reports by <br /> City staff, comments by the applicants and the effect of the proposed <br /> variances on the health, safety and welfare of the community. , <br /> 5. The City Council finds that the conditions existing on this <br /> • property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variances would <br /> not adversely affect traffic conditions, light, air nor pose a fire <br /> � hazard or �other danger to neighboring property; would not merely serve <br /> as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a <br /> substantial property right of the app licants; and would be in keeping <br /> with the spirit and intent of the Zoning Code and Comprehensive Plan <br /> of the City. <br /> CONCLDSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted above, the Orono <br /> City Council hereby grants variances to Municipal Zoning Code Section <br /> 10.22, Subdivis.ion l� & 2 to permit the construction of a deck, enclosed <br /> porch, walkway and step system, and patio, which result in hardcover in the <br /> 75-250' lakeshore setback zone of 31.8$ where only 25$ hardcover is <br /> normally allowed, and which enclosed porch and deck constitute an <br /> encroachment into the average lakeshore setback zone where no encroachment <br /> is normally allowed, subject to the following conditions: • <br /> 1. Hardcover in the 0-75' lakeshore setback zone is limited to the <br /> existing 2.1� hardcover. Applicants are advised that the existing <br /> shed in the 0-75' zone is a non-conforming structure and subject to <br /> the ordinances pertaining to such structures. <br /> • Page 2 of 4 <br />
