ORONO CITY COUNCIL MEETING <br />MINUTES FOR APRIL 24, 2000 <br />• <br />( 42568 Willow View Properties, Continued) <br />compared to paragraph 7 of the resolution previously adopted on this development which requires <br />that the internal trails on the property be constructed prior to building permits being issued for homes <br />within the subdivision. Flint stated the distinction between internal and external trails is not made <br />in the resolution now before the City Council. <br />Weinberger stated the internal trails assumes all the trails within the subdivision, and since the <br />outlots are considered to be part of the subdivision, it is understood all trails will be constructed <br />prior to any building permits being issued on this development. <br />Newman stated it is his understanding it is part of the development agreement that they have with <br />the City. <br />VOTE ON THE ABOVE MOTION: Ayes 5, Nays 0. <br />CITY ATTORNEY'S REPORT <br />Ben Sacs and Jim Dattalo were present. <br />Tom Barrett. City Attorney, requested that the City Council amend the Hovt resolution to reflect • <br />the new owners of the property. Barrett stated the City Council had previously passed a <br />conditional use permit and certain variances at the request of Mr. Hoyt. Barrett noted that <br />resolution has not been accepted by Hoyt and no building permits have been issued. <br />Barrett stated he has been provided with documentation which reflects that Mr. Ben Sacs on <br />behalf of the BRK Family Associates, L.L.C.. has purchased the property. City Staff is recommending <br />that the City Council move to amend the resolution by removing Mr. Hoyt's name and inserting the new <br />owner's name, who will be responsible for taking out the permits and completing <br />the necessary work. <br />Barrett stated the request is consistent with City ordinances and past practice. <br />Jabbour moved, Kelley seconded, to amend Resolution No. 4458 to reflect the new owner <br />of the property. VOTE: Ayes 5, Nays 0. <br />MAYOR/COUNCIL REPORT <br />Mayor Jabbour gave a brief update on the Dakota Rail to Trail project. noting lie has been meeting <br />with the various parties over the past several months regarding this project. Jabbour stated the <br />City needs to define its objectives for this project and how the unresolved issues should be <br />addressed. <br />Jabbour indicated a priority of the City should be to ensure the Highway 12 upgrade project moves is <br />[IPA <br />
