lba 5394300 <br /> City of ORONO <br /> CITY RESOLUTION OF THE CITY COUNCIL <br /> OF NO. 2392 <br /> ORONO A RESOLUTION VACATING AN <br /> UNUSED PORTION OF VINE PLACE AND <br /> A PORTION OF A PARK <br /> WITHIN THE PLAT OF SAGA HILL REVISED, <br /> SECTION 7, TOWNSHIP 117, RANGE 23 <br /> IN THE CITY OF ORONO, MINNESOTA <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS, on February 26 , 1988, Theodore O. Metz and Mary J. Metz <br /> filed a petition with the City of Orono requesting the vacation of a <br /> portion of an undeveloped park and a portion of Vine Place originally <br /> dedicated in the Plat of Saga Hill Revised legally described as follows: <br /> That part of vacated Vine Place and vacated Park as <br /> dedicated in the plat of "Saga Hill Revised, Hennepin <br /> County, Minnesota" which lies between the Northwesterly <br /> extensions across them of the Southwesterly line of Lot <br /> 2, Block 16 , Saga Hill Revised, Hennepin County, <br /> Minnesota , and the straight portion of the <br /> Northeasterly line of Lot 1 , said Block 16 ; and <br /> WHEREAS, after due published and posted notice, a public hearing <br /> was held before the City Planning Commission on March 21, 1988, regarding <br /> said vacation and all interested persons were given an opportunity to be <br /> heard; and <br /> WHEREAS, after due standing and consideration, the Planning <br /> Commission recommended approval of the requested vacation and the Council <br /> of the City of Orono finds that said vacation as proposed, is in keeping <br /> with the public interest in consideration of the following findings: <br /> 1. The vacation does not affect the access or the use of any <br /> adjoining property. <br /> 2. The City has not and does not intend to develop, improve, or use <br /> the dedicated right-of-way as a road. <br /> 3. The City has not and does not intend to maintain or install <br /> utilities within the dedicated right-of-way of the road or the park <br /> area as described above. <br /> 4. The unimproved dedicated right-of-way and park as it exists serves <br /> no public purpose as the majority of the area is inundated with Forest <br /> Lake. <br /> Page 1 of 2 <br />
