5394299 <br /> City of ORONO <br /> CITY RESOLUTION OF THE CITY COUNCIL <br /> OF NO. 2391 <br /> ORONO <br /> A RESOLUTION VACATING AN <br /> UNUSED PORTION OF FOREST BOULEVARD <br /> WITHIN THE PLAT OF SAGA HILL REVISED, <br /> SECTION 7, TOWNSHIP 117, RANGE 23 <br /> IN THE CITY OF ORONO, MINNESOTA <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS, on February 26 , 1988 , Ronald W. Bertagnoli and Sylvia <br /> Bertagnoli filed a petition with the City of Orono requesting the vacation <br /> of a portion of Forest Boulevard originally dedicated in the Plat of Saga <br /> Hill Revised legally described as follows: <br /> That part of vacated Forest Boulevard as dedicated in <br /> the plat of "Saga Hill Revised, Hennepin County, <br /> Minnesota" which lies between the Northwesterly <br /> extensions across it of the Southwesterly line of Lot <br /> 3 , Block 15, "Saga Hill Revised, Hennepin County, <br /> Minnesota" and the Northeasterly line of Lot 2, said <br /> Block 15; and <br /> WHEREAS, after due published and posted notice, a public hearing <br /> was held before the City Planning Commission on March 21, 1988, regarding <br /> said vacation and all interested persons were given an opportunity to be <br /> heard; and <br /> WHEREAS, after due standing and consideration, the Planning <br /> Commission recommended approval of the requested vacation and the Council <br /> of the City of Orono finds that said vacation as proposed, is in keeping <br /> with the public interest in consideration of the following findings: <br /> 1. The vacation does not affect the access or the use of adjoining <br /> properties. <br /> 2. The City has not and does not intend to develop, improve, or use <br /> the dedicated right-of-way of Forest Boulevard for road purposes. <br /> 3. The City has not and does not intend to maintain or install <br /> utilities within the dedicated right-of-way of Forest Boulevard. <br /> 4. The unimproved dedicated right-of-way as it exists serves no public <br /> purpose. <br /> Page 1 of 2 <br />
