C) Grading plans for pond/swale and additional filling adjacent to drainfield area designating proposed and existing contours� Applicant is limited to the use of spoils removed from pond an swale excavation. D) Execute a permanent Hold Harmless Agreement for the proposed land alteration. 2. Applicant must apply for the renewal of the original M.C.W.D. permit. 3. The disturbed areas shall be re-vegetated as soon as possible following the completion of the grading work. • 4. Al1 fill to be transported from site shall be conducted during the daily time period beginning at 7:30 a.m. to 5:30 p.m., Monday through Friday only. 5. Authorities granted by this conditional use permit run with the property not with the applicant, but are permissive only and must be exercised by application for a land alteration permit within one year of the date of Council approval, or this conditional use permit wil 1 expire on that date (February 8, 1989 ) . 6. Violation of or non-compliance with any of the terms and condi- tions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned appli�cant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, � successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property.
