The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff, comments by the applicant and the effect <br /> of the proposed variance on the health, safety and welfare of the . <br /> community. . <br /> 5. The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance <br /> would not adversely affect traffic conditions, light, air nor <br /> ` pose a fire hazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the <br /> applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> • CONCL�SIONS, ORDSR AND CONDITIONS , <br /> Based upon the above findings, the Orono City Council hereby <br /> grants a variance to the Municipal Zoning Code Section 10.24, <br /> Subdivision 5(B) approving the construction of a single family <br /> residence on a lot of 0.77 acre where 1.0 acre in area is normally <br /> required subject to the following conditions: <br /> 1. A 20' wide access easement centered on the property line <br /> between Tract D and Tracts A and B, is hereby approved. The rear <br /> setback for Tract B shall be measured from the actual lot line <br /> between Tracts B and D. <br /> 2. A grading plan slia�l be submitted f or City review and approval <br /> prior to construc�ic�:� of the driveway access to Tonkaview Lane. <br /> The driveway shal� contain an apron of not more than 2� slope <br /> and extending at ��ast 20' back from the shoulder for safety <br /> purposes where the ���_veway enters onto Tonkaview Lane. <br /> 3. If that access is not constructed and that easement is not <br /> � created, Tracts B & C �,�ould be required to share a single access <br /> to County Road 19 a.•�, a location to be determined by Hennepin <br /> County at the time � C�unty access permit is applied for. <br /> 4. Park Dedication fe� o€ $390.00 per current fee schedule to be . <br /> • paid with building ge��=�ro <br /> 5.
