� . <br /> Cit� o� ORONO <br /> • RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2320 <br /> � <br /> ' • - • • <br /> D) In a report dated October 12, 1987, the Ci�y Engineer Glenn <br /> Cook had the f o 11 owing comments: <br /> i. The proposed alteration will improve the sedimintation <br /> • capacity available and widlife habitat. <br /> ii. The proposed alteration would not appear to have any <br /> long term adverse effects on Lake Minnetonka. <br /> iii. The alteration will reduce the assimilative capacity <br /> of the marsh slightly. <br /> 5. Based on a review of the necessary findings in approving the <br /> alteration of a protected wetland, the Planning Commission made the <br /> following findings: <br /> A. The proposed alteration will not restrict the passage of <br /> f lood water or run-off. <br /> • B. The alteration will not pose a danger to life or property. <br /> � C. The proposal appears to be compatible with the City°s desire <br /> to preserve natural �.and forms, vegetation and wetlands. <br /> D. The alteration will provide greater storage or retention of <br /> run-off as a result of the increase in depth. <br /> 6. The land alteration wiYl greatly improve the safety of the users <br /> of Bohns Point Road by widening the road bed and providing gentler <br /> slopes adjacent to wetlands. <br /> 7. The applicant has agreed to excavate an adjacent Iand area of <br /> the wetlands to compensate for area fil led on east side of pond with <br /> the improvement of the public road. <br /> 8. The City Council finds that the conditions existing on this pro- <br /> perty are peculiar to it and do not apply generally to other property <br /> in this zoning district; that granting. the variance would not, <br /> adversely affect traffic conditions, light,, air nor pose a fire hazard <br /> or other danger :to neighboring properties; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a demon- <br /> strable hardship br difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the <br />; spirit and intent of the Zoning Code and Comprehensive Pl.an of the <br /> � City. <br /> 9. The City Council finds that granting a conditional use permit to <br /> allow the dredging of the wetland will not be detrimental to the <br /> health, safety or general welfare of the public, would not adversely <br /> � Page 2 of 4 <br />
