� <br /> .� .� r - d :� <br /> Cit� of ORONO <br /> � ` RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2318 <br /> � <br /> ' • � • • <br /> A RSSOLDTION GRANTING � <br /> A �lARIANCE TO � <br /> MITNICIPAL ZONING CODE <br /> SECTION ].0.23, SIIBDIVISIOAT 6 (A) & (B) <br /> FILE #1104 <br /> WHER$AS, Gregg Perl, (hereinafter "the applicant") is the owner <br /> of the property located at 309 Westlake Street within the City of Orono <br /> (hereinafter "City") and legally described as follows: <br /> Lots l, 2, and 3 except the West 270' of said lots, Block 2, Hillside <br /> Park, Hennepin County, Minnesota (hereinafter "the property"); and <br /> WHEREAS, the applicant has applied to the City for a variance to <br /> Municipal Zoning Code Section 10.23, Subdivision 6 (A) to permit the <br /> construction of a primary residential structure 35' in defined height where <br /> a defined height of only 30' is normally allowed, and a variance to Section <br /> 10.23, Subdivision 6 (B) to allow a 12' side setback for that structure <br /> where a 30' side setback is normally required, and to allow a 27.1' rear <br /> • setback where a 50' rear setback is normally required. <br /> IdOW, THEREFORE, BE IT RESOY.VED by the City Council of Orono, <br /> Minnesota: <br /> FaNDIPTGS <br /> 1. This application was reviewed as Zoning File #1104. <br /> 2. The property is located in the LR-lA Single Family Lakeshore <br /> Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application on <br /> February 17, 1987 and November 16, 1987, and recommended approval of <br /> the proposed variances based upon the following findings: <br /> A) Approval of the variance for a side setback of 12' , finding <br /> that the neighboring residence structure located at that side is <br /> more than 60 ' away, and this variance will not cause any° <br /> . significant encroachment on light, air or open space in the <br /> neighborhood. <br /> B) Approval of a variance for rear setback of 27.1 feet finding <br /> that the steep slopes behind the house makes it unlikely that a <br /> house could feasibly be constructed on the property to the rear <br /> and that that neighboring property to the rear is substandard in <br /> � size, does not have sewer available, and it is unlikely that a <br /> house could feasibly be constructed on that property except near <br /> Tonkawa Road, far from applicant's house. <br /> Page 1 of 4 <br />
