Cit� o� ORONO <br /> • k t t <br /> .;< � RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2306 <br /> ' � - • • <br /> i <br /> B) Watercraft can be closer to service area and sewage pumping <br /> facility. � <br /> C) Rip rap would require more land area to allow for the <br /> required slope from parking area to lake. <br /> D) The water quality/filtering plan is acceptable and may <br /> require less maintenance over rip rap filtering plan because wave <br /> action is eliminated. <br /> E) The site is a non-natural feature of the shoreline as <br /> property was created with filling. <br /> F) The projection of this site from natural shoreline presents <br /> unique erosion problems - seawal 1 is the most effective method. <br /> 5. The City Council finds that the conditions existing on this pro- <br /> perty are peculiar to it and do not apply generally to other property <br /> in this zoning district; that granting the variance would not <br /> • adversely affect traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring properties; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a demon- <br /> strable hardship or difficulty; is necessary to preserve a subs�antial <br /> property right of the applicant; and would be in keeping with the <br /> spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. _ <br /> 6. The City Counci 1 f inds that granting a conditiona 1 use permit to <br /> al low the installation of the seawall will not be detrimental to the <br /> health, safety or general welfare of the public, would not adversely <br /> affect light, air nor pose a fire hazard or other danger to <br /> neighboring properties, nor will it depreciate surrounding property <br /> values and that the proposed level of use of the property will be in <br /> keeping with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> co�acLUSZO�as, ox��x �an cormiTao�as <br /> Based upon one or more of the above findings, the Orono City <br /> Council hereby grants a variance to Municipal Zoning Code Section 10.55, <br /> Subdivision 8 and per Section 10.03, Subdivision 19 �grants a conditional <br /> use permit for the installation of seawall adjacent to the shoreline of <br /> Smith Bay Marina, subject to the following conditions: <br /> 1.
