The City of Orono reviewed this application on November 23, 1987 <br /> noting the written and oral comments of the applicants, the comments <br /> of staff and consultants and other reviewing agencies and made the <br /> following additional findings per required standards set forth in <br /> Section 10.55, Subdivision 25: <br /> A. The interim and final proposal, as amended, will not restrict <br /> � the passage of surface drainage to the immediate and adjacent <br /> flood plain. There is no change proposed in current drainage <br /> patterns. <br /> B. The plan, as amended, w�i i not present a detriment to the <br /> quality of surface drainage and/or ground water. <br /> • C. The plan, as amended, will not create overf Iow of water onto <br /> adjacent land areas within the Ciy or onto land areas adjacent to <br /> Minnehaha Creek. <br /> D. The plan, as amended, will be consistent with the objectives <br /> of encouraging land uses compatible with the preservation of <br /> natural land forms, ve.getation, and the marshes and wetlands. <br /> 6. The City Council finds that the conditions existing on these <br /> properties are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance would not <br /> adversely affect traffic conditions, light, air nor pose a fire hazard <br /> or other danger to neighboring properties; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a <br /> substantial property right of the applicants; and would be in keeping <br /> with the spirit and intent of the Zoning Code and Comprehensive Plan <br /> of the City. <br /> 7. The City Counci 1 f inds that granting a Conditiona 1 Use Permit to <br /> allow the placement of spoils on adjacent land area will not be <br /> detrimental to the health, safety or general welfare of the public, <br /> would not adversely affect light, air nor pose a fire hazard or other <br /> danger to neighboring properties, nor will it depreciate surrounding <br /> property values and that the proposed level of use of the property <br /> • will be in keeping with the intent and objectives of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> Page 2 of <br />
