Since this property would Iikely have <br /> been granted an autnmatic lot area variance if it was known it <br /> was under 5 acres, you would still be allowed �o construct the <br /> seasonal dwelling that is proposed. <br /> 6. You are advised that because the lot area appears to be less <br /> than 5 acres, any future request for some type of multi-family <br /> use will likely require a lot area variance. <br /> 7. Any future proposed use which is not listed in the zoning <br /> code as a permitted use but is listed as a conditional use will <br /> require a conditional use permit. <br /> 8. Any proposed future uses which do not fall strictly within <br /> the uses listed in the code will likely require a zoning code <br /> amendment, and the passage of such an amendment is not <br /> guaranteed. <br /> Based on items 1 through 8 above, a permit to construct a single <br /> family seasonal recreational dwelling will be granted, with the <br /> following conditions: <br /> l. The existing residence shall be removed, the septic tanks <br /> filled in, and the existing well properly abandoned or <br /> rejuvenated for immediate continued use by a licensed water well <br /> contractor; aIl the above to be completed prior to final in- <br /> spection of the new construction. <br /> 2. Because removal of the existing house and filling of the <br /> basement excavation will likely require the use of heavy equip- <br /> ment within the 0-75' lakeshore setback area, the builder shall <br /> provide suitable sedimentation control measures to eiiminate any <br /> sediments from entering the lake. <br /> 3. A conditional use permit is required for an excavation, <br /> f i 1 1 , temporary f i 1 I storage, or temporary or permanent "road" <br /> access grading within 75' of the Iakeshore. In addition, erosion <br /> barriers must be placed wherever there is potential for sedimen- <br /> tation into the lake. <br /> 4. Dock structures and use fal.ls uncler the jurisdiction of <br /> the Lake Minnetonka Conservation District and thP property owner <br /> is advised to obtain such approvals as may be necessary from the <br /> LMCD. <br /> A copy of this letter must be signed by the property owner and <br /> builder prior to issuance of the building permit. <br />
