The garage was never constructed. <br /> That garage was to be Iocated 39' from the lakeshore. That <br /> variance has since expired, and the current appYicant does <br /> not wish to renew the variance. <br /> E) The existing house site is relativeI.y low, near the lake <br /> level. The house has no basement, hence interior space is <br /> limited. The layout of the house limits the expandability <br /> of the kitchen and bedroom areas within the existing wall <br /> boundaries. <br /> F) The additions will have no effect on any lake views of <br /> neighboring property owners and will not be visually <br /> • perceived as a widening of the house, when viewing `from the <br /> lake. <br /> G) Hardships to the property include the lot configuration <br /> proximity to lakeshore on 3 sides, and the fact that almost <br /> the entire house is Yess than 75' from the shoreline. <br /> 4. The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff, comments by the applicant and the effect <br /> of the proposed variance on the health, safety and welfare of the <br /> community. <br />, 5. The City Council finds that the conditions existing on this <br /> property are pecul.iar to it and do not apply generaYly to other <br /> property in this zoning district; that granting the variance <br /> would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficu Tty; is <br /> necessary to preserve a substantial property ' right of the <br /> applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> CONCLDSIONS, ORDER AND CONDITIONS <br /> � Based upon the above findings, the Orono City CounciY hereby <br /> grants a variance to the Municipal Zoning Code Section 10.22, <br /> Subdivision 1 & 2 and 10.55, Subdivision 8 to permit the construction <br /> of a kitchen/bedroom addition totaling 192 s.f. of structure and hard- <br /> cover in the 0-75' lakeshore setback zone and located 42' from the <br /> lakeshore, and a sunroom addition totaling 100 s.f. of structure and <br />' hardcover in the 0-75' lakeshore setback zone and located 60' from the <br /> lakeshore, subject to the following conditions: <br /> Paae 2 of 5 <br />
