Dougan (hereinafter "the applicant") is the <br /> owner of the property located at 2785 White Oak Circle within the City <br /> of Orono (hereinafter "City") and legaY].y described as follows: � <br /> Tract A, Registered Land Survey No. 1447, Hennepin County, <br /> Minnesota, (hereinafter "the property" ) ; and <br /> ' WHEREAS, the applicant has applied to the City of Orono for <br /> a ConditionaY Use Permit to permit grading and excavation of a <br /> retention pond and swale for flood control purposes, per Municipal <br /> • Zoning Code Section 10.03, Subdivision 19. <br /> NOW, TH$REFORB, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDYNGS � <br /> 1. This applicati,on was reviewed as Zoning File #1082. <br /> 2. The property is �ocated in the RR-1B Single Family Rural <br /> � Residential Zoning District. <br /> 3. On October 20, 1986, the Orono Planning Commission reviewed <br /> the application as proposed and recommended approval, finding <br /> that: <br /> A) The applicant's property suffers flooding on an <br /> occasionaY basis. The property is relatively low within the <br /> watershed and the property is nearly Ieve1 from �est to • <br /> east, hence drainage. from the steeper watershed upstream <br /> slows down and accumulates on appYicant's property. <br /> B) The drainageway through applicant's property is not a <br /> designatecl wetland. <br /> • C) The applicant's drainfield is within the area that is <br /> occasional ly f looded and is affected adversely during such <br /> periods. <br /> Page 1 of 4 <br />
