� , . <br /> ��g� - � Cit o� ORONO <br /> d ��r�.� � <br /> • ., •�••A'• <br /> A,_ ��'"5, <br /> ;; RESOLUTION OF THE CITY COUNCIL <br /> �FS �w 2080 <br /> �;��, NO. <br /> • - • �;: <br /> B) The topography of the site is such that a stairway <br /> heading straight down to the lakeshore without prependicular <br /> landings would likeYy require unusual excavation and <br /> construction techniques and is not reasonabYy feasible. <br /> C) Existing mature trees W�ii serve to partially screen the <br /> stairway structure from the lake. <br /> D) The stairway with the proposed perpendicular Yandings <br /> wi1 1 provide a safety stop should anyone trip or fall on the <br /> stairway. <br /> E) The proposed lighting fixtures integrated within the <br /> stairway Wii i point downward and w�ii serve a safety purpose <br /> while not causing a nuisance to the neighbors. � <br /> • F) The proposed stairway and the existing pumphouse <br /> comprise a total of 2.6� hardcover in the 0-75' lakeshore <br /> . setback zone. <br /> 4. The City Council has considered this application including <br /> the findings and recommendations of the Planning Commission, <br /> reports by City staff, comments by the applicant and the effect <br /> of the proposed variance on the health, safety and welfare of the <br /> community. <br /> 5. The City Council finds that the conditions existing on this <br /> property are pecuYiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance <br /> would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would <br /> not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the <br /> appYicant; and would be in keeping with the spirit and intent of <br /> . the Zoning Code and Comprehensive Plan of the City. <br /> CONCLIISIONS, ORDB1t AND CONDITIONS <br /> Based upon the above findings, the Orono City CounciY hereby <br /> grants a variance to the Municipal Zoning Code Section 10.22, <br /> � Subdivisions 1 & 2 and Section 10.55, Subdivision 8 to permit the <br /> constructon of a stairway within the 0-75' lakeshore setback zone <br /> where no structure is normally allowed, and which structure Wii1 <br /> � increase the hardcover in the 0-75' lakeshore setback zone to 2.6$ <br /> , where no hardcover is normally allowed, and which structure encroaches <br /> into the average lakeshore setback where no encroachment is normally <br /> allowed, subject to the fol lowing conditions: <br /> Page 2 of 4 � <br />
