Paul , Minnesota 55109 <br /> Dear Barker: <br /> This is in regard to your meeting and related discussions <br /> with Mr. Joseph Yanta of the Regulatory Branch concerning an <br /> authorization under Department of the Army nationwide permit 26 <br /> (file 1994-02434-NW-JJY, which was confirmed by letters dated May <br /> 13 , 1994 and August l, 1994) . The special conditions of the <br /> permit confirmation note that the Covenant of Dedication covering <br /> wetland mitigation areas and buffers prohibit certain activities, <br /> unless approved in writing by the Corps of Engineers . You asked <br /> that we approve construction of an addition to a berm on the <br /> south (nonwetland side of the existing berm in Block 4 , Lot 5 <br /> (2965 Deer Run Trail) of the Old Crystal Bay Road Addition <br /> (Coffin Site) . This widening of the berm would allow truck <br /> access so that additional trees to be planted. No fill would be <br /> placed in any wetland (see enclosed drawings) . <br /> We have determined that this berm widening is acceptable . <br /> You should install silt fence, as necessary, to prevent any fill <br /> from migrating into the wetland (Basin C-4) , blocking <br /> drainageways, or encroaching on any other property. You should <br /> also coordinate with the Minnesota Department of Natural <br /> Resources, Trails and Waterways Division, which manages the Luce <br /> Line Trail , adjacent to the berm.
