• MINUTES OF THE ORONO PLANNING COMMISSION MEETING <br />HELD MARCH 16, 1992 <br />ZONING FILE #1721 - CONT. <br />Chair Kelley asked if Howell was aware of the City's position on <br />riparian rights. <br />Mabusth exp I a i ned that the C i ty i s i n no way attempt i ng to say that <br />they are creating new riparian rights for the property with <br />approval of the subdivision. <br />Bellows asked if the primary septic site for Lot 3 met the 75' <br />required setback. <br />Weckman confirmed that it did meet the setback. <br />Howell asked the Commission to consider allowing the western access <br />drive to remain as it has been in place for many years and has not <br />been a safety concern. <br />It was moved by Bellows, seconded by Rowlette, to recommend <br />approval of Application #1721 for Albert Hanser of 1685 Fox Street <br />for preliminary subdivision approval, subject to the lot line <br />between Lots 1 and 2 be redesignated so a variance would not be <br />required for Lot 1, the issues of the tennis court and garage <br />• encroaching the wetlands be addressed, the removal of the small <br />shed located on the property line, and allowing the circular drive <br />to remain based on the fact that it has existed on the property and <br />it has not been a safety issue. Ayes 5, nays 0. <br />• <br />( #3) ORDINANCE TO REPEAL ORDINANCE #96, SECOND SERIES, <br />PUBLIC HEARING - 8:45 - 8:46 P.M. <br />The Affidavit of Publication and Certificate of Mailing were noted. <br />It was moved by Schroeder, seconded by Chair Kelley, to recommend <br />adoption of an ordinance to repeal Ordinance #96, Second Series, <br />"An Ordinance establishing an interim moratorium on the granting <br />of land subdivisions that have not received preliminary approval <br />from the City ".
