While she agreed the home was a beautiful facility, Hawn repeated the <br /> options, which included either meeting the 4 acres of dry buildable or removing the kitchen <br /> in the guest house. <br /> Pierpont reminded the Commission that they would be paying for sewer on two properties, <br /> as well as, creating new space for a potential homeowners and tax payer in Orono, if they <br /> were allowed the rearrangement. <br /> The Commissioners agreed that they could not credit the applicants for the wetland. <br /> Rahn stated that the applicants must comply with the original resolution by either <br /> combining the two lots or losing the kitchen facilities. Since the conditions under which <br /> the original agreement was made have not changed, he asserted that it is spelled out quite <br /> clearly what the expectation is. <br /> Pierpont stated that, although she would lose the kitchen, she believed that sewer has made <br /> a significant change to the original terms of the agreement. <br /> Gaffron stated that if the guest house is converted to an accessory structure with plumbing <br /> by CUP, he would confirm with the City Attorney at a later date whether this could be <br /> made part of the Planning Commission's recommendation at this time. He pointed out that <br /> the accessory structure fails to meet the 15' setback, as has always been the case, and <br /> remains nonconforming. <br /> In order to allow the accessory structure to remain, Acting Chair Mabusth based this upon <br /> the findings that the structure's proximity to the lot line was existent, was used as a guest <br /> house, it sits on a hill with no impact to views, has a natural buffer, and has historical <br /> significance attached to it as a stable. <br /> Although it had been upgraded, Pierpont pointed out that the stable has always had <br /> plumbing. <br /> While he would first check with the Attorney, Gaffron stated that this may offer some <br /> grandfathered status since the plumbing was existent. <br /> Acting Chair Mabusth moved, Zugschwert seconded, to recommend approval of <br /> Application #03-2951, James and Judith Pierpont, 1801-1849 West Farm Road, <br /> granting the lot line rearrangement, subject to staff recommendations, the removal of <br /> the outer circular driveway; and pending City Attorney approval,while the guest <br /> house use must be discontinued with this subdivision, modifying the CUP for the <br /> PAGE 7 of 41 <br />
