t <br /> MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday, November 17, 2003 <br /> 6:00 o'clock p.m. <br /> ROLL <br /> The Commission met on the above mentioned date with the following members present:, <br /> Acting Chair Jeanne Mabusth Commissioners Cynthia Bremer, Stephanie Zugschwert <br /> David Rahn, J. Mark Fritzler, and Liz Hawn. Representing staff were Planning Director <br /> Mike Gaffron, Planners Melanie Foth and Janice Waataj a, Recorder Kristi Anderson and. <br /> Chair Sandra Smith and City Council liaison Mayor Peterson were absent. <br /> Acting Chair Mabusth called the meeting to order at 6:02 P.M. <br /> Acting Chair Mabusth submitted staffs preliminary review of the existing accessory <br /> structures on the Dayton property to examine whether or not the barn located at 2885 Little <br /> Orchard Way can be added to the estate at 825 Old Crystal Bay Road, as well as, Mr. <br /> Hoyt, the neighbor's, comments with regard to Application#03-2958, a renewal variance <br /> request. <br /> CONSENT AGENDA <br /> *(#1) #03-2960 TIMOTHY AND KELLY MAHONEY, 2760 PHEASANT ROAD, <br /> VARIANCE <br /> Hawn moved, Bremer seconded, to recommend approval of Application #03-2960, <br /> Timothy and Kelly Mahoney, 2760 Pheasant Road, granting a front yard setback <br /> variance to allow a front yard setback of 29' where 35' is normally required and 33' <br /> currently exists, due to the existing non-conforming setback, that the encroachment <br /> only includes a roof and is not enclosed, and that the 60' total right-of-way is <br /> excessive and still allows for adequate separation from the house to the paved road of <br /> 50'. VOTE: Ayes 6, Nays 0. <br /> OLD BUSINESS <br /> (#2) #03-2917 WINFIELD AND NANCY STEPHENS, 350 CRESTVIEW AVENUE, <br /> VARIANCES (6:05 - 6:15 P.M.) <br /> Winfield Stephens, the applicant, was present. <br /> Waataja explained that the applicant requests the following variances to construct a new <br /> residence on a lot subject to a 75' creek setback: <br /> 1. Lot area variance to allow a residence reconstruction on a .455 acre lot when 2 acres is <br /> normally required. <br /> 2. Front yard setback variance to allow a front yard setback of 30' when 50' is normally <br /> required. <br /> PAGE 1 of 41 <br />
