He indicated that, from a legal standpoint, it does not matter what the <br /> applicant was told upon his initial inquiry. <br /> Chair Smith asked the applicants if they wished the Commission to vote on what was <br /> before them. <br /> Mabusth encouraged the applicants to redesign and return with a new plan, since the <br /> hardships for hardcover were acceptable to the Commission. <br /> Gaffron pointed out to the applicants that even if the proposal became a remodeling <br /> project, the applicants would unlikely be allowed to replace some portions of the home that <br /> would disappear during the remodel process. <br /> Ms. Newkirk stated that it was their opinion that the redesign versus remodel was the best <br /> option given the reductions in hardcover in the 0-75' setback zone. <br /> Mabusth again suggested the applicants table to take the opportunity to work with the <br /> planners on their options. <br /> Cronin asked the Commission to vote on what was before them. <br /> Chair Smith moved, Mabusth seconded, to recommend approval of the lot area and <br /> lot width variances, and Conditional Use Permit in order to regrade the 0-75' <br /> lakeshore yard to create a natural slope where a failing 6' retaining wall exists <br /> currently, and improve drainage away from the home. In addition, Chair Smith <br /> moved to deny the side yard setback variance and to table the hardcover variance in <br /> order to construct a new home on the substandard lot. VOTE: Ayes 4, Nays 0, <br /> Abstain 1, Hawn abstaining. <br /> Hawn stated that she was uncomfortable denying the application, since she did not know <br /> what representations were made to the applicants. <br /> (#10) #03-2954 HOWARD R.
