On June 14, 1994, the City received a <br /> grading permit application for 884 Dakota Avenue and after City staff's review of the application <br /> and the .;ite, a permit was ready for issuance on June 17, 1994. <br /> I can understand your concerns over this project, however, if the applicant meets all the <br /> requirements of the Orono Municipal Code, a permit can be issued and the project can <br /> commence. The City does not have an ordinance that protects trees except within 75' of lakes. <br /> Grading is required to meet a 5' setback. Utilizing the applicant's survey and one on file for <br /> your property, a site inspection confirms that the closest work is at least 7' from your property <br /> line. <br /> You were not informed of a variance because one was not required to complete the work. If <br /> an applicant is proposing to do something that is in violation of City codes, then they may ask <br /> the City Council for a variance to that code. Again, this project was within the parameters of <br /> the code. Your letter asks how can this happen without your permission? Your neighbors do <br /> not need your permission to do work on their own property. If they wish to change their land <br /> and are within the code limits, they can do whatever they want. An inspection was also <br /> conducted by Steve Weckman, Orono's On-Site Systems Manager, and he confirmed the <br /> proposed work will have no effect on your mound septic system. <br /> Telephone (612) 473-7357 • FAX 473-0510 <br />
