MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday, May 19, 2003 <br /> 6:00 o'clock p.m. <br /> (#9 #03-2896 BRUCE BOEDER ON BEHALF OF FRANCISCUS BASTIAENS, <br /> Continued) <br /> With regard to the septic, Gaffron indicated that the City was concerned how the old septic <br /> might impact the septic for the new residence. <br /> Boeder stated that, as an engineer, Mr. Bastiaens was willing to take the risk and was <br /> comfortable with the old septic. <br /> Hawn moved, Rahn seconded,to deny Application #03-2896, Franciscus Bastiaens, <br /> 665 North Ferndale Road, a request for a Guest House CUP and variance to the lot <br /> area requirement. VOTE: Ayes 2, Nays 3, Chair Smith,Bremer, and Zugschwert <br /> dissenting. <br /> Bremer moved, Zugschwert seconded, to recommend approval of Application #03- <br /> 2896, Franciscus Bastiaens, 665 North Ferndale Road, a request for a Guest House <br /> CUP and variance to the lot area requirement, subject to staff recommendations, <br /> except that the applicant be allowed to utilize the existing septic system; and that a <br /> two year sunset date and financial arrangement between the applicant and the City <br /> Attorney be agreed upon. VOTE: Ayes 2,Nays 3, Hawn, Rahn, and Chair Smith <br /> dissenting. <br /> Chair Smith moved, to recommend approval of Application #03-2896, Franciscus <br /> Bastiaens, 665 North Ferndale Road, a request for a Guest House CUP and variance <br /> to the lot area requirement, subject to staff recommendations except that the <br /> applicant be allowed to utilize the existing septic system; and that a one year sunset <br /> date and financial arrangement between the applicant and the City Attorney be <br /> agreed upon. Motion failed for lack of a second. <br /> After three failed motions, Gaffron indicated that the application would move forward to <br /> the City Council for their recommendation. <br /> Mrs. Bastiaens voiced her frustration with the City that her 6 acre property had been <br /> reduced to a mere two acre usable parcel, and now the City had seen fit to even further <br /> restrict their use of their property. <br /> (#10)#03-2898 MIKE AND JULIE WHITTINGTON, 1981 FAGERNESS POINT <br /> ROAD,VARIANCES, 12:09— 12:20 A.M. <br /> Mrs. Whittington, the applicant, was present. <br /> Mabusth explained that the applicant was requesting a variance to permit construction of a <br /> deck and stairs 5' in height onto the existing home, requiring 5,596 s.f.
