MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday, May 19, 2003 <br /> 6:00 o'clock p.m. <br /> (#3 #03-2869 DR. ROBERT GUMNIT, Continued) <br /> hardship on the second matter. He questioned whether the Commission believed the <br /> applicants should have a right to that use or if it should take place elsewhere. <br /> Mabusth stated that the hardship could accompany the fact that 1.8 acres of their dry land <br /> on the island is surrounded by water; therefore, it is considered shoreland' by new zoning <br /> standards. <br /> Chair Smith maintained that, while the overall property could support 7 horses, she did not <br /> believe the island or knoll could do so. She recognized that if they were to be fed by <br /> pasture, the applicants would be required to provide more acreage than that provided by <br /> the knoll. <br /> Graham reiterated that they would only be keeping their horses when they had free time, <br /> for instance weekends or weeks off for vacation. <br /> Hawn maintained that it was the Commission's responsibility to look at the bigger picture <br /> and impose restrictions that would accompany the property should ownership change. <br /> Chair Smith moved to approve the reconstruction of the gravel driveway, not to <br /> exceed 12', and the intermittent keeping of no more than 4 horses on the knoll at one <br /> time, for no more than two weeks at a time. <br /> Since their three horses, currently, would only visit the location and not be kept there <br /> permanently, Graham stated that she did not wish to be limited further. <br /> Hawn questioned why the applicant was resisting this compromise, since the Commission <br /> was led to believe that the horses were only to be kept for infrequent visits from the start. <br /> Chair Smith reiterated that, without restrictions, the Commission would not likely look <br /> upon this application favorably. She stated that the Commission could table the <br /> application, move to deny without restrictions, or move to approve with restrictions, if the <br /> applicants wished. <br /> The applicants Attorney asked for a three minute consultation from 7:27—7:30 P.M. <br /> Upon their return, the applicant's attorney stated that they would accept the terms that not <br /> more than four horses be allowed at one time, and asked that the intermittent language be <br /> defined as not more than four weeks at a time. <br /> Hawn suggested that, coupled with a manure plan, they stick with two weeks at a time, <br /> with a five day interval between visits, for a total ten week maximum a year. <br /> PAGE 8 of 39 <br />
