MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> Monday, November 18, 2002 <br /> 6:30 o'clock p.m. <br /> (#10) #02-2852 PUBLIC HEARING <br /> Gaffron indicated that Tonkaview Court is a privately maintained shared road/driveway <br /> within the dedicated City right-of-way. He noted that hardcover is not an issue for either <br /> property. Finally, Gaffron added that a revised version of the survey and revised legal <br /> descriptions would be required prior to Council action in order to clear up past survey <br /> inconsistencies. <br /> With regard to easements, Gaffron stated that the 1985 vacation was conditioned that the <br /> Caples' grant a 20' drainage and utility easement over the center 20' of the vacated right- <br /> of-way. Gaffron explained that the applicants would be required to provide the City with <br /> copies of all easements currently affecting the properties, and sufficient title information <br /> to satisfy the City Attorney that the lot rearrangement can be filed. In addition, Gaffron <br /> pointed out that it is standard City policy to request that new drainage and utility <br /> easements 5' on either side of the new lot lines be granted as part of the lot line <br /> rearrangement approval. <br /> Gaffron indicated that staff recommends approval of the lot line rearrangement subject to <br /> three conditions put forth in the staff memo dated November 18, 2002. <br /> There were no public comments. <br /> Hawn questioned whether the new lot line rearrangement would cause difficulties with <br /> regard to the easements. <br /> Gaffron indicated that the 20' drainage and utility easement over the center 20' of the <br /> vacated right-of-way required as part of the 1985 vacation would accomplish the City's <br /> goals. <br /> Mabusth asked if the hatched area on the overhead should be vacated or if it were <br /> already. <br /> Gaffron stated that this area need not be vacated. <br /> Mr. Koopman stated that, essentially, they are landlocked from their home. <br /> Mr. Affeldt explained that the former owner built his driveway over the property line, <br /> knowing full well he had done so, which has now forced the new owners to correct his <br /> costly error and make it right. <br /> PAGE 14 of 29 <br />
