MINUTES OF THE <br /> ORONO PLANNING COMMISSION <br /> Tuesday,January 22,2002 <br /> 6:30 o'clock p.m. <br /> (#5) #2333 PROPOSED ZONING CODE AMENDMENT, SECTION 10.20, SUBD.4C, <br /> HOME OCCUPATION STANDARDS, 7:42 p.m.—7:43 p.m. <br /> Berg moved,Kluth seconded,to table Application#2333,Proposed Zoning Code Amendment, <br /> Section 10.20, Subd. 4C,Home Occupation Standards. VOTE: Ayes 6,Nays 0. <br /> NEW BUSINESS <br /> (#6) #02-2737 CHARLES PYLE,JR.,3548 IVY PLACE,AFTER-THE-FACT VARIANCES, <br /> 7:44 p.m.—7:48 p.m. <br /> Charles Pyle, Applicant, was present. <br /> Bottenberg stated the Applicant is requesting after-the-fact variances to permit the replacement of an <br /> existing lakeside deck and repair a walkway. The deck and walkway are located within 75 feet of the <br /> lakeshore. The deck and some boards in the walkway were old and deteriorated. <br /> A variance to structural lot coverage is required to permit 20 percent lot coverage by structures where <br /> 15 percent is allowed. A variance to hardcover within the 0-75' is also required to permit 18.67 percent <br /> hardcover where none is allowed, and a variance to lakeshore setback is necessary to permit 243 square <br /> feet of structure within 75 feet of the lakeshore. <br /> Bottenberg stated the design of the deck is an equal replacement to what existed. To meet today's code <br /> standards, the footings were required to be raised above grade,higher than what existed, so an <br /> additional step was added. The square footage of the deck increased by approximately 30 square feet to <br /> meet the standard. <br /> Staff recommends approval of the lot coverage by structure and hardcover variances. The Applicant is <br /> required to remove 177 square feet of landscape fabric under rock. <br /> Pyle stated they were unaware at the time this project was started of the number of railroad ties that <br /> existed in the area. Pyle stated they ended up removing 20 railroad ties, which were then replaced with <br /> keystone. Pyle stated he was unaware they needed a permit to replace the ties. <br /> There were no public comments regarding this application. <br /> Hawn moved,Mabusth seconded,to recommend approval of Application#02-2737, Charles Pyle, <br /> Jr.,3548 Ivy Place, granting of after-the-fact variances to structural lot coverage, hardcover in the <br /> 0-75' setback,and lakeshore setback to permit the replacement of an existing lakeside deck and <br /> repair a walkway,with the understanding 177 square feet of landscape fabric will be removed. <br /> VOTE: Ayes 6,Nays 0. <br /> PAGE 12 <br />
