MINUTES OF THE <br /> ORONO PLANNING COMMISSION MEETING <br /> MONDAY,NOVEMBER 19,2001 <br /> 6:30 o'clock p.m. <br /> (#6) #01-2734 MARGIE NEWTON,505 ORCHARD PARK ROAD,VARIANCE, <br /> 7:59 p.m.—8:09 p.m. <br /> Margie Newton, Applicant, and Thomas Bren,Contractor,were present. <br /> Weinberger stated the Applicant is requesting a variance to permit an existing horse barn to remain on <br /> the property located closer to the front property line than the new proposed house. Orono's Zoning <br /> Ordinance prohibits accessory buildings from being located closer to the front property line than a <br /> principal structure. <br /> Weinberger stated the Applicant is proposing to construct a 621 square foot addition to the barn. The <br /> proposed building would be 1,700 square feet. Any building over 1,000 square feet is considered an <br /> oversized accessory building. The barn location meets standards required for special setback <br /> regulations that apply to private barns and stables. The Applicant currently has two horses on the <br /> property that she would like to retain. <br /> Weinberger stated new soil testing and septic design has been submitted by the Applicant and approved <br /> by the City's on-site septic manager for a four bedroom house,which could be expanded to a five <br /> bedroom is needed. <br /> Staff is recommending approval of the variance to permit the oversized accessory building to remain on <br /> the property based on the existing building location,the best building site on the lot is located behind <br /> the barn,and it allows for a walkout at the highest lot elevation. <br /> Mabusth noted the riding arena would also be subject to the principal structure setbacks. <br /> Bren indicated the paddock area would just be used for pasture. Bren stated at this time they do not <br /> intend to use it for anything but pasture. <br /> Hawn recommended the Planning Commission grant a variance for accessory use to the land. <br /> Rahn inquired whether the original house has been removed. <br /> Weinberger stated the house was removed a couple of weeks ago. <br /> Newton indicated the addition to the barn would be used for storage, noting she has a camper she <br /> would like to store inside. <br /> Bren stated the principal residence would be constructed prior to the addition to the barn. <br /> There were no public comments regarding this application. <br /> Hawn moved,Lindquist seconded,to recommend approval of Application#01-2734,505 Orchard <br /> Park Road,granting of a variance to permit the oversized accessory building to remain on the <br /> property without a principal structure,subject to the construction of the principal residence <br /> located behind the barn occurring prior to the addition to the barn,and granting of a variance <br /> permitting accessory use of land.
